Falkvinge expounds the meme that “liberty is defended with four boxes” (in order):

  1. Soap box (appeal to public opinion)
  2. Ballot box (voting repressive officials out of office)
  3. Jury box (overturning repressive laws in the courts)
  4. Ammo box (armed conflict against the subverters of liberty)

Although Falkvinge is best known for his attempts to get the second box working again through the international Pirate Party movement, in this article he evaluates the contingency that descent into totalitarian fascism will make the resort to the fourth box necessary. Remarkably, he states that “The United States is lost; it is beyond help and repair and will descend. Our job is to prevent Europe from happily following suit”. Falkvinge expresses a concern that harsh, arbitrary, and unpredictable punishments will cause marginal deterrence to fail; that is, a sliding scale of increasingly severe penalties will no longer be available to deter escalation to drastic violence on the part of those who are already at risk of punishment. “When anybody can be locked up indefinitely for nothing, there is no reason to follow any law anymore, ever”:
